On 30th September 2024, the Commission Delegated Regulation (EU) 2024/2564 amended Regulation (EC) No 1272/2008 with regards to the harmonised classification and labelling of certain substances (CLP) which was published in the Official Journal of the European Union.
The regulation entered into force on 20th October 2024. To ensure a high level of protection of human health and the environment, suppliers can apply the new or updated harmonised classifications and adapt the labelling and packaging on a voluntary basis before the date of application 1st May 2026. After that time, the new requirements become mandatory.
Of note:
- The regulation added new harmonised classifications for 27 substances to Annex VI of CLP. This includes the following among others:
- α-methyl-1,3-benzodioxole-5-propionaldehyde [CAS 1205-17-0], 2,4-dimethylcyclohex-3-ene-1-carbaldehyde [CAS 68039-49-6], hexyl salicylate [CAS 6259-76-3] commonly used in laundry and cleaning products, air fresheners and in the fragrance industry
- silver in massive, powder, and nano form [CAS 7440-22-4 and Index 047-004-00-9, Index 047-005-00-4, Index 047-005-00-4 appropriately]
- copper [specific surface area > 0,67 mm2/mg] [CAS 7440-50-8] which covers the deleted entry for granulated copper [CAS 7440-50-8]
- substances classified as CMR cat. 1 that are permitted for use by professionals only: acetone oxime [CAS 127-06-0], sodium 3-(allyloxy)- 2-hydroxypropanesulphonate [CAS 52556-42-0], benthiavalicarb-isopropyl (ISO) [CAS 177406 -68-7]
Additionally, specific concentration limits (SCLs) that were previously established for reproductive and developmental toxicity for certain perboric acid, sodium salts were entirely removed from Annex VI. For those substances, new ATE values for oral and inhalation toxicity have been assigned.
- The regulation amended harmonised classifications for 16 existing substances in Annex VI of the CLP. This includes but is not limited to:
- N-hexane [CAS 110-54-3], formaldehyde [CAS 110-54-3], formic acid [CAS 64-18-6] – more stringent classification applied due to physical properties or human health effects
- trimethyl borate [CAS 121-43-7] – tightened classification as CMR cat. 1
- peracetic acid [CAS 79-21-0], dibenzoyl peroxide [CAS 94-36-0], dicamba (ISO) [CAS 1918-00-9] – expanded classification to include acute and/or chronic environmental toxicity
- The regulation deleted entries corresponding to borate index numbers 005-017-00-7, 005-017-01-4, 005-018-00-2, 005-018-01-X, 005-019-00-8, 005-019-01-5 and 029-024-00-X
